Nextel Cup Series driver Jimmy Spencer and his son were arrested late Sunday night at Spencer's Cornelius, N.C., home, police said.
According to a Cornelius Police Department spokeswoman, Spencer interfered with officers Sunday evening while they attempted to serve a warrant on his son, James Johnathan Spencer Jr.

Jimmy Spencer was arrested and charged with disorderly conduct and resisting a public officer, both misdemeanors.

Police also served the warrant on Spencer's son, who was arrested for one misdemeanor charge of injury to personal property.

The arrests took place at approximately 11:20 p.m. Eastern Sunday, according the arrest reports. The spokeswoman said both processed within an hour.

Spencer, 47, drove in Sunday's Subway 500 at Martinsville (Va.) Speedway Sunday afternoon for his Morgan-McClure Motorsports team, which is based in Virginia. He finished 29th.

Officials with the team could not be reached for comment late Tuesday.

James Johnathan Spencer and another individual are accused of pouring paint on two cars at a Cornelius residence on Oct. 6, police said.

A message left for Jimmy Spencer went unreturned late Tuesday.

Spencer has earned the nickname "Mr. Excitement" for his brash speaking style and rough driving on the track.

Last season, fellow driver Kurt Busch filed an assault complaint against Spencer after Spencer struck Busch after a race at Brooklyn, Mich., while Busch sat in his car. Busch later dropped the complaint. Spencer was fined $25,000 and suspended for one week by NASCAR.
 
Ole Jimmy can't stay out of trouble and gets fired. I'll always like him just because he popped Kurt Busch in the head. Hope he catches on with somebody else.
