UMP doesn't have a leg to stand on if lawyers get involved.

Since there has already been a press release issued wherein the Gerstner teams has admitted to using "products" in their tire program, And whereas DirtCar has a published tire rule that states: "Chemicals or tire softening is not permitted at any time".....A judge would probably dismiss this case pretty quickly.

You guys can dice it, slice it, mince it, throw it in the food processor any way you want. DirtCar has a clearly stated rule. "No Chemicals on tires permitted". Don't know how much clearer it can be. Kloss violated that rule. Wether it was with a tire prep/simple green/Dawn detergent/or a combination of things. It was something that they were doing for every race, the tires were reacting to the so called "products" and obviously they felt they were gaining a competitive edge by adopting this "tire program". That my friends, is cheating.

As far as the "chain of custody" matter. What difference does that make???? They already told the UMP official "here is a sample of what we put on our tire." Isn't that the same as saying "We put chemicals on that tire"?????????? You've already admitted guilt, why are you now going to challenge the way the sample was taken? Thats just stupid!


I will agree with one of their statments. There should be (if there isn't already) a clearly published fine and penalty, and yes everyone should be held to it.

I think the rule is pretty clear. No chemicals on tires. IMO that would include soap. And if I were in doubt about using any product, I would shoot Sam an e-mail and keep a copy of his answer on file.

If Casey Anthony is walking free...any thing can happen in court. I would bet it depends on how good UMP's lawyers are.

What if a the tire iron they used to cut the sample was contaminated by another tire?? Do they thoroughly clean the iron after each sample taken??
 
I've been entertained by hours of reading on all this tire treatment stuff. But something just hit me reading Racingfan03's statement. The next time a car puts fluids on the track should the push trucks run that in instead of us? Nice hot tire soaking that stuff up... I don't know. Just a question.
Yes, if they want to protect the integrity of their own rules.

If the Gerstner letter is accurate, probably not. They don"t even bother to record the compound of the tire in question.

That is if you believe the accounts told in the Gerstner statement. Keep in mind the source....someone who was caught cheating. That ranks them pretty low on my credibility list. And isn't it kind of odd that samples have been taken all during summernationals, yet the only one complaining about the procedure are the guilty party and their supporters.

You people are all starting to sound like mini Johnny Cochrans.
 
Saddest thing about all this.......there is a guy who finished 2nd that actually won fair and square. Never got his picture taken. Guy who got 3rd that is now 2nd.........son on and so forth.

In addition to the tire sample, we offered samples of the products that are used in our tire program which DIRTcar refused.

You all assume that "products" implies that they actively have a tire program, when "products used in our tire program" could be a multitude of things beyond plain 'ol water.

DIRTcar had the sample tested at Blue Ridge Labratories and provided us with their results. Based on their testing methods, they concluded that our tire sample did not conform to the controlled sample.

I know others have touched on this, and I've helped race teams off and on...but racers have been using "tire cleaner" and brake cleaner to help scuff tires as long as I can remember. And who's to say what a driver runs over in the pits on the way to the track or ON the track itself. I'd assume any type of fluid that comes in contact with the tire would deviate from the "controlled sample."

I'm not condoning cheating. And I'm definitely not condoning the business Mr. Geiseking is in, but based off what I have read in his responses, UMP has a lot to improve on with their tire testing procedures (from the ground up) before they start handing out fines, suspensions, and penalties.

I think your post is based on the assumption that the Gerstner press release is true and factual. That in itself is very questionable. I don't know them or Kloos and have no axe to grind but there's something very fishy in their statement, in my opinion.
 
Hey 01cratefan,, I can read english,but we can tell you cant now!! That was a piss poor statement and they where pointing fingures.They are a bunch of damn liers and cheaters. They are contradicting there own words just like Kingeddy said!!! There highland rats and done said they dont buy there tire prep,so that means they must me getting it somewhere for free.Maybe Nick Giesiking is a silent sponsor(aka crown cuts or bleedblue). dirtboy; you should know by now I like busting your boulders on here. I don’t know what caused that tire test to come back dirty and neither does anybody else commenting on here. Some would call cheating a liberal interpretation of the rules and less than honest answers spin. One thing I think is certain. Whatever the cause it must have been from something other than accidental exposure based on their statement. I’m not surprised they’d try to put the best face possible on there remarks but that doesn’t change the fact their reputations have suffered damage difficult to ever repair. some of us are the worst critter of all, good all southern illinois boys, that have flown the coup to become big city scroundrels but who still love to see the dirt fly. also bloomy deserves a bigger fine for being such a jerk & if I was Billy Moyer & Tyler Reddick jumped out of his car & ran over to my car to check my tires, I would have slapped him & said have Bloomy come check them if he wants them checked. 714 victories to 1 punk.

By law, murder is illegal in the country. Yet how many cases have been dismissed to due improper procedures by police. Drastic analogy, but the same rule applies here.

True, but murder cases (or any other cases for that matter) don't go to trial when there is an admission or plea of guilt. In their statement Gerstners admitted guilt when they typed the words "products we use in our tire program" and "we accept full responsibilty for our tire". Just get over it and accept the fact that they were caught cheating. They seem to be willing to do so, why cant you?

But lets put the Gerstner statement and tire sample drama aside. IMO, There was enough info to DQ them immediately at the track that night. They confessed and offered samples of products that were used on their tires to a UMP official at the track. The rules clearly state "No Chemicals on Tires". GUILTY...CASE CLOSED!

In the rules, its pretty much spelled out in black and white. Even the simplest of cretans should be able to understand it.....UMP doesn't want you putting any chemicals on your tires!!!!! That means no Tire Preps, Conditioners, Armour-All, Dawn, SimpleGreen, Brake Cleaner, Paint Thinner, A-Jax, Shout, WD-40, Lisol, Listerine, Shaving Cream, CocaCola. NOTHING! They all contain chemicals.

And I don't get the whole tire washing concept. When you roll the car onto the track their dirty again instantly. If your washing them with anything but plain water and for any reason other than trying to clean mud off and keep it out of your shop.... YOUR CHEATING! "Tire Washing" is just a facade your hiding behind to shield what your really doing. Most soaps contain lye, which is a caustic chemical. Chemicals are not allowed on Tires!!!

I've heard a lot of drivers talking about using Dawn to clean tires. I've asked some of them why they use it. You should hear the reasons I get. Probably heard 15 different ones. All ranging from "It takes the oil off the surface" to "it draws the oil out to the surface" to "it makes them softer/harder" and everything in between. All of them say they feel they are gaining an advantage by doing it. Well guess what???? By doing this, you are chemically altering the tire.....Which..... IS ILLEGAL!

And before anyone starts on the chemical run-off in well water crap. Don't. Your just being silly and argumenative. Mother nature naturally perks watershed from farmland and removes most impurities just as it does from your septic tank. If your concerned about it, why are you drinking it????? Why haven't you had your water tested??? I think I would be more worried about what I was putting in my body than on my tires.
