Injured fans already planning to sue Dis.

I hope it works out for all involved as well but isn't there a disclaimer about pieces coming from track that may cause injury on back of ticket. It has been quite a while since I have had a nascar ticket so cannot say for sure. just curious. Big Paul
 
I heard the same thing about the disclaimer, but i have never been to a nascar race, or seen an official ticket.. Hope to this year some time.
 
Is anyone shocked by this?? Wonder how this will be settled. That will be the shocking part of this bad and unfortuante accident.
 
why be shocked even at the local tracks there are signs that claim objects may come into stands and to set at your own risk. it is an unfortunate deal but you are setting close to cars traveling at a high rate of speed
 
Here is what the back of my Bristol ticket says for this year. The print is in all Bold letters and all capital letters..... BMS REGRETS THAT ITS EFFORTS AS TO SPECTATOR SAFETY DO NOT ELIMINATE ALL RISK OF INJURY TO SPECTATORS. DEBRIS FROM AN ACCIDENT MAY ENTER THE SEATING AREA RESULTING IN SERIOUS INJURY AND/OR DEATH. EVENT ATTENDANCE WITH A LARGE CROWD CARRIES ADDITIONAL RISK OF INJURY. YOUR PARTICIPATION IN THIS RACING EVENT AND ALL RELATED ACTIVITIES AS A SPECTATOR IS AT YOUR OWN RISK AND YOU AGREE ALL RACE PARTICIPANTS, SANCTIONING BODIES AND ALL EMPLOYEES, AGENTS, OFFICERS AND DIRECTORS OF BMS, IT'S PARENT AND AFFLIATED COMPANIES, ARE HEREBY RELEASED FROM ANY AND ALL SUCH INJURIES, DAMAGES OR CLAIMS ARISING FROM THIS EVENT.

I am sure this kind of statement is on the Daytona tickets as well.... The back of Hockey tickets say basically the same thing.. ENTER AT YOUR OWN RISK kind of statement...
 
I read the press release from the lawyer that was hired by 3 spectators and DIS commented as well and they said a lot has to do with basically liability and fault ....... They also posted what the back of DIS ticket said. And shared the settlement from Charlotte and the tire incident a few years back.

That's not what I meant Lisa. I meant don't believe what you read on the back of the ticket. If it meant anything to a good attorney race tracks wouldn't have to have multi million dollar insurance policies. Was told by a very good attorney once that those disclaimers aren't worth the paper they are written on.
 
If they win this ,they should be banned from all NASCAR racetracks! JMO! Our sue-happy society strikes again.....
 
Covering medical expenses is good but if these fans use this as a big moneygrab I hope they and their attorneys suffer a slow painful death.

Just kidding on the painful death but I do hope karma hits em' hard if they do.
 
People have tried to sue hockey clubs, baseball teams and other sporting venues in the past, and it does boil down to the same thing. When you enter the facility, you are assuming a risk. It doesn't matter if it is on the ticket, posted on a sign, or even announced. When you go to a race track, even if there is a catch fence, you still take on some risk. I mean, how long did these people p*** on the lid before someone told them to lift it up? I think next time I go to a race, I'll not wear sunscreen and sue because I got sunburned and no one told me it could happen.
 
With a accident like the one at Daytona it is a given that they will be sued. There are lawyers laying in wait for this kind of thing to happen. Yes, Dirt girl, Charlotte settled out of court (most do) for what was somewhere around 15 million!! Let's face it anyone, race fan or not, you would be tempted by the possibility of getting that kind of money. The big difference is between ticket with a disclaimer on the back, and sighing a disclaimer (like you do when you enter the pits.) is big. But sometimes not big enough. I raced at Santa Maria Speedway for years, one night one of the good guys rolled his car and was hit by another right on the top of the roll cage. He was severely injured and ended up paralyzed. The lawyers swooped in and sued the track, the ambulance personal and company for further injury pulling him out of the car, the track officials for letting him drive a unsafe car(!?!) The track almost went under with the lawsuit pressure battling with it's insurance company (or file bankruptcy). Luckily the injured driver was willing to settle out of court for a sum that was reasonable for his quality of live forever in a wheel chair and medical bills. The track made it through and continues to run to this day.


Many years ago a wonderful article written by Peter Egan. (Road & Track and Cycle Magazines) Talked about our society of people that do not take responsibility for their own actions. He proposed a membership in a group of people willing to wave their right to litigation for their "dangerous" actives. With this membership, you and ONLY you will be able to participate in; racing (all kinds) fly small planes, skydive, etc. etc. you get the drift.

The lawyers were all over this on saturday im sure. They are like a bunch of vultures when stuff like this happens jmo
 
Was sure a bad wreck. all it did was make my wife goofy, as she knows i sit up close on all the dirt tracks i go to, as take my brother-in-law with me some. i know there's a risk besides getting hit by dirt clunks & I assume it & 20smoke, they all vultures my nephew is big time one in atlanta & wow has it changed him & not for the better.
