Sorry, valves do not affect displacement at all; that engine was probably just worn out.

King Richard won a race with a big engine back in the day, and got caught; i think his brother-in-law was thrown under the bus for that. In that case, the fine was tiny in comparison to the size of the operation.
 
If my calculations are right(IF) if you have a stroke of 3.3 and a bore of 4.1552209 you get 358.0000 to be .17 over you would need a bore of 4.1562075 that is a difference of .0009866 Now how many machine shops measure bore to one hundred thousand thousandths. Even if you round it to ten thousandths it is only 9 ten thousandths over on the bore. please correct me if I'm wrong... I'm not an engine guy or a machinist. I can't imagine a $200,000 fine for a guy on a tight budget just trying to get an extra hone job out of his engine. JMO
 
Another thing to consider is head gasket thickness will also affect cubic inch. As well as if the heads had any refinish work done on the surfaces.

Head gasket does not affect cu. in. It will affect compression.

The bore and stroke is the determining factor in cubic inch displacement.

Years ago i attended a engine class and was tod by the instructor at the time head gasket thickness can throw off cid's by .001's . I have done some reseach and cannot back his claim up.so i guess im wrong. My bad.
