Loyd Donelson (AKA SirquiK) is attempting to sell a race car on E-Bay that he never paid for, therefore it is being reported as stolen.. A gentleman's agreement was made, actually with a written agreement. And he decided that the $400 left he was to pay was not worth the trouble to send. We will see if it was worth his trouble when he is in front of a judge. See you in court Loyd.

Have you contacted Ebay about this? I would think there was something that they could do to ensure that it isnt sold, in turn moving your car to another location.....

I do not know your exact circumstances but you better be carefull reporting this as STOLEN. If you gave it to him with a agreement to pay later this car is not stolen. They will not file criminal charges you will have to go after him in civil court.
 
He has 100% feedback on Ebay.

Set up an Ebay account (you can have multiple Ebay accounts, only use this one for this transaction) and use "Buy it Now", but don't pay for it

Leave negative feedback after you buy it.

If he reports you to Ebay (which I don't think he will if he knows it's you) explain the situation to them.

You won't have to pay and his feedback will show he isn't an honest person

Won't get you your $400 back, but it will hurt him in the future

Lenny great advice.......if it were me..........i would just go whip 400$ worth of his :eek:................some peeps just never learn!!!!!!!
 
this car is not stolen. been involved in a real similar deal on here( not a car, it was a helmet) there was no money involved, it was a lend, and had a hard time getting it returned. i asked the local authorities about it being a possible theft issue, they said no, because i willingly let the person have it. it became a civil issue, and i (would have)had to let the courts handle it. this is a civil issue, because the original owner let the present owner take it. it was not taken without permission. certainly have a good case, but cannot use the word 'stolen'.
 
The dictionary definition of stolen is simple, it states "Taken dishonestly". This car was taken dishonestly. We appreciate all the advice and just want to give evryone a heads up on old Loyd for future reference. We have contacted E-bay but have yet to get a response. The main problem with small claims is that he lives in Illinois and we live in Missouri so that complicates things. It also complicates things in criminal charges. Loyd has caller I.D. and will not return any phone calls from us. He has had quite some time to pay so I doubt, that after selling it, we will see our money.

is not the car he got from you he got this car from tim brown tim sold to loyde you are talking about the black car he got not this one i know this i was freinds with him when he got the other car i myself put this 24 car togeather my self this is a leaf spring car the other car is coil spring what he did is not cool but you got the wrong car he has 2
 
Im in no way a lawyer but that is not the legal definition. "STOLEN" is the past participle from the word steal. In a court of law, you have to prove that the person INTENDED not to pay for the car. Wich as we know is difficult since this was a gentlemens agreement, I beleive? I went through this same scenario with a guy named Ray Wohlshchlager, who continuosly jerked me around. We went to small claims and I won. I will tell you how. did you get any kind of "bill of sale" from him, wether it was a partial one or full one? Can you show cell or home phone records, of transacting calls concerning this car deal? Did you have a unbiased witness, during this transaction? All you have to do is explain to the judge that you have made every effort to either retreive your money or merchandise and he INTENDED, to DECEIVE you. I woudl not use the word steal, stolen or theft. But I would use the word KNOWINGLY DECEIVE you. Since he hasnt paid you in full for the car and is now trying to sell it on ebay, I would think a judge would side with you since he is now knowingly trying to deceive you.

Thats not going to happan,, Every time I see him in the past he would brag how much money he makes driving a truck,,I would think $400 would be nothing to him,,lol...He also screwed Tim Brown on parts Tim let him barrow and tried to keep,Then returned some parts that wasnt the parts that were loned,,,, Tim called him and told him if he didnt return the right parts he would whip his butt at the track in front of God and everyone, he came to Tims house gave the parts to Tims son and burnt rubber leaving,,, this is facts cuz I was there when Tim loaned the parts,, and when Tim called him, Either You call loyd or have a lawer call him,asap,,, Good luck hope ya get your money.........

33L car that he has on E-bay. It is black and yellow. Thanks again for everyone's advice.
