New DOT and EPA rules

The way I read it RV'ers beware! If you have a 5Th wheel trailer or travel trailer that has a GVWR of more than 10,000lbs you need a class A license which opens another can of worms. From what I have read on other message boards most state do not mess with the RV people but I guess it is up to the officer. Personally I think they should leave the private people alone and just worry about the commercial people only. All the rules and weigh scales were made and built for commercial trucking. not private parties.

Also if you have less then 1000 lbs of haz mat on board you do not need placards or cdl with few exceptions for what is called "placard any quantity". Stuff like radioactive and poison gas Really nasty stuff. The 1000 lbs only applys to stuff transported not to fuel in the truck or car tanks or gen tanks and such. If you have 3 55 gallon drums of fuel you are over the limit but anything less then that and you are prob ok unless you carry a lot of oil or something. the 1000 lbs is total for all haz not for each item. Hope this helps and if anyone wants CFR chapters and references i can get them but it is a pain to find. Thats why i did not put them in.

I have trouble once in awhile remembering who agrues so much on internet forums , 99% are guys that sit in the stands moans and complains about everything and know more than anyone who actually does something. I agree 100 percent. the intent of this thread was to get people to realize if they have a name or advertisement on their trailer.........they are subject to get pulled over. Never said they are actually a commercial vehicle. but its up to the officer. I also agree on the 1,000 lb rule and know that. People can buy an ERG book which gives you a listing of chemicals you can transport.................how much....and what you cannot intertransport chemicals with. But.............fuel jugs which are clear are not considered DOT approved containers. This is where it gets sticky. Every taken one of those to a gas station and be questioned as to what that container is rated for??? Bingo. Point made. Battery acid is also a material you cannot transport unless placarded. How many have a spare battery in their trailers??? I could try to find a link....if someone needs it to the ERG listings but you can probably google it and get it there. Its really better to overdo than not do at all and thats why i posted this also. Just take a look at what you got..how you transport it. If any more info is needed.....i can try to help those that need it.

Plus......2 drums of racing fuel should weigh about 480 lbs a piece. Thats 960 lbs right there. Thats(for those who dont get it) 55 times 8(gas weighs around 8lbs per gallon...give or take a lb or 2)
 
What about the not for hire? If you are not getting paid to drive this is it really a cmv?

Deal is this. If you have a name.or business on a vehicle.............you can be considered a DOT or commercially operated vehicle. The weight thing.........dont think about that. Think of how your representing your vehicle. Taking the signing off....slapping a not for hire on there will satisfy their curiousity. Our pickup trucks at work....have Icc numbers on them, Wanna know why???We have our company names on them. They are considered Commercial vehicles. Trust me.......company lawyer went through this with us. I used to work for a wrecker service. Was ran 3/4 ton truck. Since a company name was on them....we were required to maintain icc numbers and cdl's. Were we over the cdl weight rating??Nope. Did this because one of our driver's got pulled over and wrote up for that. No need to argue that point with DOT. Been there.done that. Their decisions are final.

I agree 100 percent with your post and thank you for the reply. Its spooky as to what info you are told in meetings and training as to what all they are looking for and wanting to do. Just like the DOT requirements for CDL drivers. My god.........blood pressure must be below 140 over 80 is what they want. I know alot of people including myself that is right on that line and have been that way since i was a kid. Sleep apnia..............determined in a CDL physical test. Judgement call 100 percent. They can yank your license right there and nothing you can do about it till you pay for an actual sleep apnia test at a hospital which will be an overnight stay. Wonder if the insurance will cover that??? Terrible..really terrible. This is things they are wanting t do. Other things will be enacted in June of this year with strict log requirments and giving the DOT officers alot more power as to what they can do. Here is an example. your driving and woopwoop. Sirens go off and you get pulled over. Officer says.....i pulled you over because i seen you swerve back there. You reply.......officer.........im tired and only 300 miles from home. Guess what??Officer can NOW write you up..put you out of service just because of your reply. Officers judegment is final. Sad but its true now.Funny because ive talked to some companies(Walmart.....Schneider...ect) and they know nothing about this but yet.......ive been to 3 classes on it and its coming June 1st. So........more officers. Stricter enforcement means they are not out there to play games and just get who they want to get. Everyone will be in the same boat. Also..added note if you read cvsa 2010. Your CDL license will also have a safety point record. This record will go back 3 years. Any violations you have had DOT wise.......or driving wise will be on there as of June 1st. That record will follow you from job to job. The days of covering up speeding tickets with parking violations will be gone. Your company(if your an idividual.youll be considered your own company) will also get a safety rating according to this new system. All facts here.....read the link i put up cvsa 2010. And browse trucking forums. Its all over the place.
 
For those who want to jump on here and say this thread is all about nonsense........talk to Jimmy Dearing. Site owner and operator and have him take this down. Ive repeatedly backed up the facts and willling to help anyone who needs more info.
 
I found that out yesterday as well as took a copy of posts and rules for Fastrack. People who buy tire treatments from whoever can be fined by the EPA according to Fastrack. Dont run Fastrack?? Good for you......now. EPA has jumped aboard and is pursuing other was to get rid of soil contaminants. Just the sole fact Bleed your business sells this chemical and advertises it...makes you liable as well. Just stating the facts. I never said..peope dont buy anything from this guy or youll get popped for sure. Stating that eyes are on alot of things now. Who knows who comes here and reads what is posted??? I personally dont care what your business does or how it does it. But its an illegal tire treatment...hence the undetectable statement. You cannot beat around the bush on that statement at all. Your stern words wont scare me nor make me back down as its all hot air. Dont like the response.......or the thread man up and PM Jimmy Dearing and get it pulled. so far.its still up. You getting on here with idle threats will get you nowhere and quite frankly.....get a chuckle or 2 out of me:D

I think that is a point everyone should be paying close attention to. With all these broke azz governments, local, state, and federal, they are looking at anything the can possibly find to generate funds. Notice the glut of speed traps lately, the building inspectors coming around more than usual,all the talk of red light cameras,raising this tax or another? Even heard an ad the other day from the IRS promoting turning in anyone that you thought was cheating on their taxes, with a promise of a reward of 30% of what they collect, if memory serves me correctly.

Racers just check the regulations, we don't need, or should be, giving any of our racing funds to these government dummies! They created these monsters that they have to feed,try not to let them feed them your money!

You guys are completely off base. Nothing, and I will repeat(because it seems your comprehension skills seem a little slow) nothing about my preps are Illegal. They are against the rules of sanctioning bodies, not the law. Just because the NFL says a supplement is Illegal in their rule book doesn't mean that the supplement is against the law.

I pmed Jimmy Dearing a copy of this and will leave it up too him. If he is happy with you advertising your product on here and doesnt mind you threatening people who have a response about your product.........let alone warning of new laws and rules....its in his court. Its a public forum and its all up for discussion on here. I was warning you..warning others about the new rule and let me tell you. The EPA will be getting more involved with local racing. Not my problem. I dont sell anything they would want to look at.
I have over 4,000 replies on this forum and have been here awhile.
We have alot of people who come to this site.....see how many views alone on this thread! Its been pased on several other sites and noone seems to have an issue with anything i have said.....on those sites. I put this up here to let people look at their operations alot closer and fix things if needed. Ive been racing for 12 years....drove for 9. Got alot of friends and im not afraid of speaking my mind if i feel like it(hence....public forum). If you advertised on the net noone could reply to your stuff and all would be hunky dory. As i said before..i learned long ago if you put info out there in public and its scrutinized........aint much you nor i can do about it. Its an open forum. Ive also gotten alot of support through emails and pm's. Nothing in this thread demeans your product(as you request).........just stating the way i role and why i do it.
 
Now...back to the discussions. I received several emails and i responded to them. Ill try to do my best to help anyone out. I can also get a copy of ERG books for hazmat materials......if people need them. We got some old ones we basically throw away.
