Zoning Ordinace Violation

Sounds like us voters are going to be full force at the polls this year, new officials in fact. i really think a lot of us racers, fans ,owners, promoters and any one else who might be interested needs to run for piblic office and put a stop to this bull butter. I think we should all keep this in mind when it comes election time and get rid of the officials that are in office now, sometimes the votes speak louder than meetings or anything else.

I spoke to one of the zoning folks. They are not after racecar owners. They say this has little to nothing to do about the racecar. Apparantly there is a painting business registered in the Madison County Business Registry for this address. There is some issue relating to that registration. They asked that I pass along that they are NOT after the racers.
 
One other possibility is to contact the city employee that issued the warnings and ask him exactly why he thinks it is a business as opposed to a hobby. Of course this gets trickier if you actually take money or goods from sponsors in return for advertising on your car. It is different if it is just a gift. Regardless, lose the sign.

Well that is good to know that they aren't trying to claim that his racing is a business operating from there. I guess if he has a painting business registered at that address, he needs to change the address at the business registery for the county. If it was a previous owner that had it registered there, then that shouldn't be too hard to clear up.

The business that is listed under my address have moved and I talked to the previous owner (my brother) and let him know that ne needed to change the address with the county. I got a letter from the city today. Part of the letter says " Personnel from this department have witnessed six cars under repair and a large trailer partially blocking the allyway on a saturday." Of course this is when we are loading my two cars on the two car hauler to go racing and two buddies had come by with their race cars (on trailers) to caravan up to Highland Speedway. The other two cars was my personal car and one is a parts car (for racing) that I have under a car cover. I thought it was funny that nowhere in the letter did it say anything about race cars being at the address or that they were on trailers. In fact the cops were by that same day and said one neighbor had complained about noise. The officer told her that it was race day and we had to tune and load our cars and we were not doing anything wrong.
Hopefully changing the address for the business will fix everything. When I talked to the code official about that the business had moved and that the address would be changed. She said I would have to mail her a letter stateing so, and they would review it. If this does fix the business violation. I wonder what my neighbor will try next?:confused:

Now this is starting to cross over into borderline harassment. Why should racers basically be forced to go into hiding, as if what they do is somehow "dirty"? What's next, are they going to make racers register like sex-offenders?:mad:

She worked straight midnights, instead of comming and talking to us, she had to be a bully and send in Johnnie law. After that we could only work on our car from 2 pm till 9pm. She's gone now,moved on, but it only takes one complaint.

I could see a neighboorhood not wanting a racer to be starting the motor up late at night. That would be simply expecting common courtesy, like forbidding someone to mow their grass at 10 at night, or at 6:30 on a Saturday morning. But what the h-ll skin is it off any neighbors back if you're simply working on the car? How does it affect their quality of life if you're in your shop, say, changing rear-end gears?
 
Like Brandon said the 6:30AM grass cutter or the 5AM let my dog out that barks constantly under my window Monday through Friday are the real problem here. This Neighbor of mine actually had the audasity to call the city on me for my kids riding their go kart in the back yard. Some people can't even see past their own nose! Forced me to move. But to top it all off one of my other neighbors at the time called the cops on me for driving the car down the street past 2 houses and back, and this is after he landed his experimental air plane on our STREET.

Incorporate your Race Team. That is what Dan and Bob did with having the late model and made Nickel and Dime motorsports.

I dont think that solves the problem. Most ciites, like Highland, have rules against having a business in an area zoned residential. That is what caused the problem to begin with.
 
See what it would take to get Zoned commercial and then go get a business licences for your racing team so they cant do nutin about it.
 
You will need to get a special use permit to operate a business out of your home if that is how they (the city) wants to go after you. If you do not claim any winnings or losses on your taxes tell them that it is a hobby no different than if you had a jon boat sitting in the yard.
