MCS Is Being Sued as "PUBLIC NUISANCE"

I typed in Gundecker, Gordon and got only got 3 cases the last in 1995.
 
Then just type in Gundaker and then look through all the pages and you will find it

Why would Gordon say a track is a problem when he owns one. I have talked to gundakers and other people involed and was told its NOT Gordon it his PARTNERS.
 
Hell I Will Help out As Much As I Can Be Dirt Tracks Are Going To Be extincted if we dont do something and also if it was gundaker i would like for him to give us a answer why he did it
 
It's not Gordon, it's his Partners is lame, try telling that to the cops if you and two others walk into a bank and rob it.
 
Keep in mind anybody can go to the courthouse and file a lawsuit. Anybody on this board could technically sue anybody else and go to court if they choose to go through the trouble, so this thing might never even make it to court.

Since MCS is a relatively new racetrack, did Gundaker (or whoever the developer is) own their property first, or did Mel own the adjacent racetrack property first? If MCS was built before the other property was even sold, I don't see how there can any legal complaint, unless the county actually has a noise ordinance.
 
Futhermore, if that tower may fall and needs a place to fall, it sounds like the tower is the public nuisance.

Perhaps Mel should counter sue claiming that the tower is a danger to the public.
 
01CV155791 is the number 2cd page of lawsuits involved in!!!!!! And Jennifer get a clue, do you think you are an intrigue part of Gundaker Enterprises and they reviel such vital information to you being honest and open like that WOW close relationship. And gee whose lawyer is that? Partner’s right!!!!! LOL I wouldn’t want people to know what a low down two-faced move I pulled either!!!! Wait it’s the guy on the grassy knoll that filed the lawsuit!!!!
 
Read a little more.

If you would have looked a little more you would have seen that the date it was filed was 10/23/2001 and was Dismissed by Parties on the date of 12/05/2003.

Whoa..well..well...who knows whats going on here...time will tell. 1 thing for sure....Judge Wapner is retired...and wont be handling the case.

If you looked at case #04AA-CC00005 the date filed was 02/23/2004 I've yet to see any this year.
 
You not only told everyone where to look at the case, but youve also made it to where people see all their personal stuff. I know its public record but we dont need to know the other stuff.
 
I didnt mention they have have filed the same suit 3 times now I belive. And guess what, lost the first 2 but hey you can just keep trying the great american way!!!!!!!!
 
Joe, I was just going to add that. And they will continue losing until Mel gives up. It costs tens of thousands of dollars per year to fight this, and Gundaker has attourneys on payroll. Mel is all by himself, I'm just glad he finally told everybody. I also heard that they probably are trying to pressure him so they can buy the place and then they will have a Sat-Sun deal, that also explains the Peavely deal???? Makes Sense. I have been telling everyone on this site for years what happened in Denver They have no Dirttracks anymore. Corporate tracks are whats going to happen in decent locations. The only Mom and Pop tracks will be in the Boonies like Callaway Raceways, and if they are not in the middle of several hundred acres you bet even they are threatened.
 
You would think there comes a point in time its harrasment or frivolouis, but hey like Westling said (right on by the way) they figure sooner or later someone will mess up or run out of money for laywers so they can win.
 
Well, in addition to sending a letter supporting the track, I'll make sure that I'm going to the right ones. That's about as low a move as I've seen in awhile. It's kind of sad what people will do for money.
