A mechanic works for a Mom and Pop repair shop. He likes working there and especially likes the way the shop’s owner treats him as a person and an employee. One day the shop owner tells that mechanic, “Hey, looks like my business may be in some legal trouble now.” The owner goes on to explain that the shop is being sued for being “A public nuisance.” Apparently a homeowner on the same block as the shop has filed suit against the Mom and Pop automotive repair shop with a list of complaints:
* There’s inoperable cars parked in the lot
* There are exhaust fumes and other foul smells permeating from the business
* There are loud sounds such as pneumatic tools emanating from the premises
* There are undesirable characters that appear to be unclean at the property regularly
The shop owner further tells him that he’s spoken with his own attorney and they will most likely be able to win the fight BUT the legal expenses associated with the battle will be more that the owner and his wife can finically carry. The mechanic knows he can get another job, but like working at THAT place and more importantly like the family that owns the shop… So, after work he puts down his wrench and goes into amateur super-sleuth mode.
He starts with the list of complaints. The repair shop is properly zoned and licensed to be located there. The results of this search go something like this:
* “Inoperable cars?” Uh, yeah! They are there to be fixed! That’s what a repair shop does!
* “Exhaust fumes?” He thinks to himself, “There are no fumes coming out of my shop that wouldn’t come out of any place where an automobile is running.” That’s just goofy!
* “Loud sounds?” Well there is certainly air tools used there. What did anybody expect?
* “Unclean people at the property” The mechanic realizes that complaint is pointed directly at HIM and his coworker. I’m a mechanic not a freakin’ banker! Of course I get dirty sometimes at work. What the heck kind of complaint is THAT?!?!!?
This mechanic is now pretty understandably riled up, right? The last little tid-bits of information he learns are these. The complaining neighbor is well connected in the community and knows people of power and influence. The complaining neighbor is a self-made man of considerable wealth. The complaining neighbor is among other business a SILENT MAJORITY FRANCHISE PARTNER IN __(insert national chain name here)__ TIRE AND AUTO located in the next town over.
__(insert national chain name here)__ TIRE AND AUTO that complaining neighbor has ownership in has inoperable cars in the parking lot!

Moonflow!!!! Haven't we been attempting to bring this to light for about six months now and 40 some odd pages of posts? Dude you are scarin' me if you are really just now seeing that correlation. Honestly? Or are you just being funny?
We need to find someone that lives by some other racetrack, that feels they too are a public nuisance and chip it to file a lawsuit for them!!!!
I suppose not till everone involved loses something will this be dropped.

Man, please don’t take this as a personal attack on you. I’ve read MANY of you post and you often offer good advice to many other STLRacing users. Especially when it comes to folks needing help with their passenger cars. You are always quick to with the assistance. I know many that appreciate your posts, and I’m one of them.
You’ve seem to have posted several things on this thread that has gotten under people skin. That includes me! As someone that has followed this issue very closely and have done my best to inform myself the on the matter some of your post have been WAY out of place.
1) You’ve told people that despite them having read official court documents that there information posted here is incorrect.
2) You’ve told people that have spoken directly to parties involved with the civil action that once they post the information gathered directly from a vested party that the information somehow magically becomes null and void.
3) You’ve placed a halo on the Gundakers for the good they have done at TCS, so much so, that you seem to suffering from serious denial that what is happening IS HAPPENING.
I know from my part it’s highly frustrating to see you or anyone else state while doing no research on a subject state that other posters known correct information is incorrect.

Apology accepted.Its all good..i was ..or i thought..i was saying my side best i could. Apperently..i screwed that up. I understand..and good post.racin90 - I sincerely apologize for the typing remarks. I was out of line. I was just angry that you kept saying that this entire thing is based on hearsay when it really is not. Hearsay is a rumor - this is not a rumor - there is a lawsuit pending that has the potential to shut down a race track. That is the truth. This lawsuit is being brought by people who own a competing race track. That is the truth. The part that really irked me was that you kept saying you wanted a public statement. For the past however many months we have all been waiting for a promised public statement. If you go back to the early days of this post a public statement was promised that was going to clear everything up - nothing has ever come of that promise other than to tell us all we don't know what is really going on. Then the radio interview even muddied things up more because the comments he made there were directly contradictory to what his son had been saying on here. They were also contradictory to his own partner's statements. In my view, no clarification that was going to make us all feel stupid for criticizing his actions came to light from that radio interview. It just made more questions. Mel does not use the internet. So what? That doesn't mean a darn thing. My 75 year old uncle doesn't use the internet either but he does have a cell phone. You were given Mel's number and told that you could contact him to hear his side if you really wanted to. But, instead of doing that you continued to say this is all just hearsay and that we are all blaming the wrong people. Check out the facts before you start criticizing other people's points of view on this issue. It doesn't matter to me which side you support, but at least know what the real facts are and base your opinions on that. There are a lot of people that have been following this deal for a long time and to say that we are all basing our opinions on anything other than fact is just plain wrong to do. Court documents are not meaningless as say they are. They are actually very powerful. This case is very serious and has the potential to cause some very ugly repercussions in our racing community. That matters to me. Many would like to believe that there is something else to this story that's going to make it all not so bad (as would I, to be honest) because we have been being told that for months. So far that "something we don't know" hasn't been brought to light by anyone even though a promise was made that it would be. I was wrong to pick on your typing - I agree with that, and for that I do apologize, but please try to understand where I was coming from.
