I'm a little confused. I went to case net and was looking at the case. I understand the motion to dismiss was deined. Now on Oct 31 there was a motion to withdrawl by a lawyer I'm not sure whos lawyer is who's. Can anyone help? Also why are the lawyers pulling out? I know Mel and Gundaker can change there lawyer if they want but you have to pay them all something.The motion to dismiss was denied it has to go to trial now. Dont know about withdraw, other then lawyers want a lot of money that’s one of the points MONEY. Now it takes a whole new bunch of money for a trial so they are getting what the want, to run the man out of money!!!!!!!!!

You would have to get the info from Kevin, but what I was told was that a while back Kevin or his dad was approached by the opperators of Lake Ozark, but after looking into it discovered the land was leased and the equipment was all they actually owned. And they decided it was not worth investing in a place if they didnt get the land.

Id like to thank the person who thought it was cute to send me some negative rep points..and called me..an idiot..classy. I am not anywhere near an idiot but if you think i am then so be it. Cant please them all and...i know who posted them..lol. Posted here..then..quickly posted negative reps. Ill say this..i respect anyone and everyones views on this and i will not downplay there opinions as they are. I am behind Mel..with whatever help he needs..but i still say..Kevin needs to be left out of this. Nowhere on any documents...does it say...Kevin /Gundaker. Nowhere. Want to bring Gordon into the picture go for it. His name is on there but...so are others in this group. How come noone bashes..them? Or asks them to make a statement. Dont think they know of this post by now..on stl? Im thinking this is read by some who youd never even think of and word has gotten out. And i will not contact Mel because i know he has seen this post..knows of it and has not responded personally. Neither has Gordon neither has anyone else. Probably due to the legal issues at hand which i can respect since ive been in that situation before. So we probably wont hear anything concrete till this hits the courts and that seems to be awhile. Till then..just be curtious and be respectful to others..who do have opinions. I have respected each and everyones and ill say..some have been some darn good posts..especially by #28. Opened my eyes to the deal. Thanks

T-c's announcer comes to this site. If he had a beef..it would be on here..trust me on this one. Nice guy and does an awesome job. Also heard he has renewed for next year. The worker not getting paid..please. 1 side of the story and once again...they probably come here as well. If they had issues with it..it would be posted. You didnt copy and past it..to save it? Im shocked. Is some of this info coming from the Star magazine? How much of an idiot am i know? Im just curious. My SAT's were not the best and i imagine my IQ isnt up there with Einstein. Its a defect in my family jeans i guess

Mel has had more than one oppertunity to present his side of the story and has declined to do so, therefore if he wants to act like LiL' Abner I don't really care anymore. Actually the way both sides have acted I was thinking because of the coming holiday season sending both parties a Banjo.

Id say call him and ask him (even though you spek for him which we know you feel so strongly about, hearsay and all) but you dont call people either do you. I saw it and it just was requesting monies owed to the announcer and his wife for their last night of worked. They have requested several times to aguire the monies they feel was owed to them on their last night of work. My "PERCEPTION" of the post was they had been trying to get paid to no avail. So they went PUBLIC.. Then it was removed for whatever reasons Jimmy Dearing chose. I am not saying that his post was accurate or correct as I have no idea. Jimmy usually allows things to go. Sometimes I question his censorship. But 99.999 percent of the time he is right on for whatever reasons he has. But the post was there. Not something you thought was brought out to slander the track management...

Ok..i never said..it asnt posted..i said..where are you getting the facts..lol. Man..the post obviosly was made of lies or was all just a bunch of nothing but harrassment. So..my opinion..means nothing..sorry. Yea..im slow..thanks for point that out eat dirt...I would have never known
And..thank crate..i didnt see if personally but thanks for the good word.The reason Mel is probably not putting out a statement on here is that they are in the middle of a lawsuit and the lawyers will probably want to review and edit anything he says on the subject. They do not do that type of work for free and I would rather have Mel spend his money on winning the suit in court instead of spending it on a PR message for all of us on a bulletin board. Anything he says will be picked apart in court, so keeping quite is probably the smart thing to do for now.
Regardless of what is going on behind the scenes, I think most of us can agree that suing a MCS as a public nuisance after it went through all of the proper channels to be built, had the opportunity for public input before being approved, and then has operated well within the law is pretty slimy. If there is some other issue between all of them, file a suit on those grounds instead of filing a frivolous nuisance lawsuit (especially after loosing other nuisance suits in the past few years). I would love to see someone put up the money for Mel to afford to file a counter-suit.
